NOW COMES John Henry Doe, who replies to Plaintiff's Prayer to Dismiss Counterclaim as follows:
1.) Plaintiff's original credit agreement contained no notice that signature would be accepted for value, monetized, and converted into a "loan." These are essential terms which would have affected the agreement. Non-disclosure of these essential terms has resulted in a fraudulent contract. - Restatement (Second) of the Law of Contracts, §§ 162 - 164
2.) Because Plaintiff has earned interest from my property, which was taken without my knowledge or consent, they have been unjustly enriched. Such unjust enrichment should be awarded to a claimant - Restatement (Second) of the Law of Contracts §344.
WHEREFORE, I pray that the Counterclaim be included in this action.
